A criminal ruling issued by the Sichuan Higher People’s Court revealed that from May 2011 to January 2013, when Ding was the director of the computer center of the information center of a well-known third-class hospital in Sichuan, he provided project information to Liu in the process of purchasing equipment in the hospital, and helped the products of three technology companies represented by Liu in the process of project comparison and selection, which enabled the three companies to gain advantages in the procurement competition and successfully signed equipment sales contracts with a third-class hospital. According to a judgment document of the People’s Court of Yongqiao District, Suzhou City, Anhui Province, during his tenure as the business manager of a pharmaceutical company in Anhui Province, in order to sell fructose water, hemagglutination enzyme and other new and special drugs to a health center in Yongqiao District, Suzhou City, in violation of state regulations, Zhang was given a drug rebate of RMB 2,225,010 in 35 times in the office or residence of the president of the health center.

In addition to off-road vehicles, high-end mobile phones have also become a tool for some lawless elements to "drill". According to the criminal ruling of the Intermediate People’s Court of dehong autonomous prefecture, Yunnan Province, Shen Mou, former deputy secretary of the Party Committee and president of Dehong State Hospital of Traditional Chinese Medicine, received an "8848" brand mobile phone from Zhou Moumou in June 2018, with a value of 15,999 yuan. In November 2019, Shen Mou handed it over to Zhou Moumou for maintenance, and Zhou Moumou bought a new "8848" brand mobile phone for 5,800 yuan through trade-in.

In 2015, a criminal judgment issued by the Sichuan Higher People’s Court disclosed in detail the whole process of Chen Mou, the former president of the Second People’s Hospital of ziyang (jianyang city People’s Hospital), being "hunted". During the Spring Festival from 1998 to 2013, Chen Mou took advantage of his position as the president of jianyang city People’s Hospital to accept Liu’s request and seek benefits for a group in the construction of jianyang city People’s Hospital project, and successively accepted Liu’s bribes through himself or his ex-wife Zhong.

According to a criminal ruling disclosed by the Intermediate People’s Court of Xuzhou City, Jiangsu Province, from March 2012 to May 2013, when Zhang was the director of the functional inspection department of a hospital in Xuzhou, he took advantage of his position in economic exchanges with an equipment company in Xuzhou and illegally accepted medical film kickbacks from Sun in violation of state regulations. From March to November, 2012, he was given a 2 yuan rebate for every film used, and a 3 yuan rebate for every film used after December, 2012, and the settlement was made according to the number of invoices issued by Sun and the hospital. After accounting, from March to May 2012, November to December 2012, January 2013 and March to May 2013, a total of RMB 83,000 was received from Sun, of which more than RMB 10,000 was used for department dinners and academic meetings. After the incident, Zhang’s family returned RMB150,000.

Eating 16 million kickbacks at a time, "corruption of petty officials" can not be ignored.

In many cases, there is no lack of "corruption of petty officials" among medical staff in some primary hospitals. In 2020, a criminal ruling of the Intermediate People’s Court of Fuyang City, Anhui Province showed that on August 24, 2011, a hospital in Fuyang City appointed Bai as the director of the 120 emergency sub-station of the hospital and Zhang as the head nurse. The emergency vehicles in the sub-station are uniformly dispatched by Fuyang 120 Emergency Center, which undertakes the work of "pre-hospital first aid" and "long-distance transport". The "long-distance transport" mainly transports the patients in this hospital to hospitals in Hefei, such as provincial hospitals and provincial children’s hospitals, with a charge of 2,000 yuan each time.

According to the investigation of the judicial organs, the substation collects long-distance forwarding charges mainly in cash. After discussion, Bai and Zhang decided to intercept some long-distance forwarding charges and not hand them over to the hospital finance department. From January, 2012 to August, 2017, the emergency vehicles of the substation were transported to Hefei for 389 times, and they were handed over to the finance department of the hospital for 80 times of long-distance transportation fees. Bai and Zhang intercepted 309 long-distance transportation fees, and after deducting the personnel subsidy, refueling fee and toll fee, the total amount of long-distance transportation fees embezzled by them was 306,000 yuan.

The judgment document also shows that in 2011, Bai was the driver of Hou, the president of the hospital. In order to arrange for his son to work in the hospital, Bai sent 10,000 yuan in cash to his home when Hou’s daughter got married, and his son worked in the hospital by contract. Before the Mid-Autumn Festival in 2012, Baimou gave his friend Zhang 50,000 yuan in cash to ask him to take care of it, and then the hospital signed a contract with Zhang to increase the variety of drugs. Hou, the president of the hospital, was sentenced to four years in prison on July 18, 2016 for accepting bribes and fined 300,000 yuan.

In 2017, a criminal judgment from the People’s Court of Gaoyou City, Jiangsu Province showed that from January 2008 to February 2016, Sun took advantage of prescribing orthopedic consumables for patients in a hospital in Gaoyou City, and illegally accepted more than 6,850,800 yuan from Shao in his home, hospital duty room and office several times according to the corresponding proportion of his use of orthopedic consumables sold by Shao, in order to seek benefits for Shao in selling orthopedic consumables in the hospital.

In May this year, the State Commission for Discipline Inspection of the Central Commission for Discipline Inspection exposed a corruption case: Yang Wenjun, former deputy secretary and president of the Party Committee of Pu ‘er People’s Hospital in Yunnan Province, and Yang Wenhong, former member and vice president of the Party Committee, were brothers with suppliers, eating and having fun at will, and receiving gifts and gifts. When the hospital was discussing the purchase of a medical device linear accelerator with an import price of 15 million yuan, other members of the hospital leadership clearly opposed it, but Yang Wenjun insisted on buying it and finally reached it. In the end, the hospital bought it for 35.2 million yuan, and Yang Wenjun ate a rebate of 16 million yuan.

Cheat 8.75 million medical insurance funds and be wary of "collapse" corruption.

According to the relevant provisions of the Criminal Law and the Supreme People’s Court’s Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Unit Crimes, it is a unit crime to commit a crime in the name of a unit, and the illegal gains are owned by the unit. According to the website of the State Commission for Discipline Inspection of the Central Commission for Discipline Inspection reported on August 7, bribery in units is mostly found in "three episodes" such as centralized power, intensive capital and rich resources, and is named in the medical and health field.

In 2020, Chongqing notified a nationwide "case of defrauding national medical insurance", and 133 party member cadres and public officials were investigated and punished for violating discipline and law. According to the judgment documents of the Fifth Intermediate People’s Court of Chongqing, Chongqing Xuefu Hospital is the designated unit of medical insurance in Chongqing and the designated unit of cooperative medical insurance for urban and rural residents. Its shareholder is Chongqing Xuefu Hospital Investment Management Co., Ltd., and Liang is the chairman, legal agent and actual controller of the company.

From 2013 to 2014 and 2017, Liang hired Zhang as the general manager and dean of Chongqing Xuefu Hospital, responsible for the daily operation and management of the hospital. At the behest of Liang, Zhang directly managed the Public Welfare Section I and Public Welfare Section II of the operation center through the deployment of middle-level cadre meetings, quarterly business meetings and weekly regular meetings in Chongqing Xuefu Hospital, and the staff of these two departments recruited residents from districts and counties with medical insurance to come to the hospital for medical examination in the name of free medical examination; All departments of the hospital are required to cooperate with each other, and then the national medical insurance funds are defrauded by means of empty hanging patients, extending hospitalization days, inflating the number of drugs and forging hospitalization medical records. Later, Liang and others used forged drug purchase records, and the drug company falsely issued invoices and manifests to the hospital to level the hospital accounts, and transferred the money returned by the drug company to the private account designated by Liang, some of which was used to distribute employees’ remuneration and rewards.

In the process of fraudulent insurance, Zhang is responsible for issuing monthly target tasks to all departments of the hospital and urging them to complete them at the meeting. In order to ensure the smooth process of fraudulent insurance, Zhang asked all departments of the hospital to coordinate and cooperate in the aspects of taking fake patients to stay in hospital, hanging patients, idling drugs, and controlling the amount of medical insurance reimbursement; Take the way of "anti-settlement admission" for false inpatients to avoid the inspection by the Social Security Bureau, then sign a preferential bill to exempt the inpatients from paying their own expenses, and take measures to conceal the real accounts and corresponding accounting vouchers from the hospital financial department and implement two sets of accounts; It also provides false accounts to the social security bureau, audit institutions and other departments.

During the period from January 2013 to December 2014 when Zhang worked, and from January 2017 to November of the same year, Chongqing Xuefu Hospital defrauded medical insurance funds totaling 8,759,075.2 yuan. On December 1, 2017, the public security organs investigated and dealt with the insurance fraud incident in Chongqing Xuefu Hospital. Zhang was summoned to the case on the same day and did not truthfully confess the facts of the crime after arriving at the case. In order to seek illegitimate interests such as improving the medical insurance quota of university hospitals, Zhang and Liang conspired to pay bribes to Wen (sentenced), then deputy director of the Human Resources and Social Security Bureau of Nan ‘an District of Chongqing and director of the Social Insurance Bureau of Nan ‘an District. Later, Zhang paid a total of 470,000 yuan to Wenmou on behalf of Chongqing Xuefu Hospital, either alone or appointed by Liang.

Retirement is not a "safe", and violations of law and discipline will be corrected.

It is worth mentioning that among the "top leaders" of the medical system, there are many retired and retired people. In July 2018, Zhu, a former party secretary and dean (deputy director level) of Bo ‘ai Hospital in Zhongshan City, Guangdong Province, was expelled from the party and cancelled his retirement benefits due to serious violations of the law.

In 2019, a criminal ruling of the Guangdong Higher People’s Court disclosed the process of Zhu’s bribery. At the end of 2009, Han knew that the hospital was going to buy a CT machine, so he expressed to Zhu that he wanted to undertake the business and promised to give Zhu a benefit fee. Zhu agreed, and Han immediately contacted Cai Mouzhan to promote the Siemens brand CT machine. After an investigation team composed of Ren and others from the hospital, he decided to purchase the Siemens brand CT machine. On March 30, 2010, a Siemens spiral CT machine of a company in Shenzhen won the bid for 19.83 million yuan and signed a sales contract. After the company delivered the equipment, the hospital also paid for the goods. After Han received the commission, in order to thank Zhu for his support and care in the process of bidding and purchasing spiral CT machines in the hospital, he bribed Zhu with RMB 850,000 in cash and paid US$ 20,000 at Zhu’s request.
