  Well-known hospitals have won social reputation and public praise by virtue of their medical strength. However, some medical institutions use the brand names of well-known hospitals such as "Xiehe" without legal authorization, defrauding and misleading the people, endangering the health of patients in medical activities, seriously infringing on the legitimate rights and interests and public image of regular hospitals, and disrupting the normal medical order. In this regard, the social response is strong.

  This time, the market supervision department cleaned up and rectified the counterfeit problem of well-known hospitals, with the attitude of being responsible for people’s life safety and health, further intensified its work, thoroughly investigated the counterfeit problem of well-known hospitals, and built a barrier for people’s life, health and safety.

  The General Administration of Market Supervision requires a comprehensive clean-up of market players with well-known hospital names. For-profit medical institutions that have not applied for medical institution licenses or whose licenses are inconsistent, they shall be ordered to change their names; For-profit medical institutions and enterprises in hospital management, medical beauty, pharmaceuticals and other related industries, if their names deceive or misunderstand the public and harm the legitimate rights and interests of others in use, they shall be corrected according to law. For-profit medical institutions other than well-known hospitals are not allowed to use well-known hospital names such as "Xiehe" in their names without the direct authorization of the obligee.

  This clean-up and rectification focuses on investigating and handling illegal activities. Severely crack down on unfair competition and price violations in the medical field, severely crack down on publishing false and illegal medical advertisements, and severely crack down on trademark infringement violations in medical institutions. Focus on investigating and dealing with enterprise names that violate the relevant provisions of the Anti-Unfair Competition Law, causing people to mistake them for commodities of well-known hospitals or have specific connections with well-known hospitals; Intensify efforts to crack down on medical institutions’ unauthorized use of well-known hospital names such as "Xiehe", or the use of illegal names to publish false advertisements, deceive and induce patients, and exaggerate the condition or curative effect; Strengthen the protection of trademark rights of well-known hospitals.

  The General Administration of Market Supervision requires that the credit supervision of for-profit medical institutions should be strengthened, and information related to administrative penalties, spot checks and inspection results of market entities such as for-profit medical institutions should be publicized to the public in a timely manner through the national enterprise credit information publicity system in accordance with laws and regulations, so as to strengthen credit punishment. At the same time, strengthen coordination and communication with health departments and establish a long-term mechanism for brand protection of well-known hospitals.
