There is still a legal gap in who is responsible for the loss of "flash delivery" goods.
1 minute response, 10 minutes door-to-door, 60 minutes full delivery … … From express delivery in the same city, same-day delivery, to one-to-one delivery service calculated by minutes, endless express brands and delivery modes provide more convenience for business needs, and also solve the urgent needs for the public. However, the fast-paced delivery link will inevitably encounter accidents, such as damage and loss of goods, resulting in disputes. In Shanghai citizen service hotline 12345, there are many complaints about one-to-one delivery service, some of which have reached a settlement, while others have been left unattended for several months.
"12345" according to the usual handling mode of express complaints, when the work order was transferred to the postal management department for processing, it was rejected. According to the postal administration, such distribution is not in the category of "logistics express delivery" and therefore cannot be accepted.
The mobile phone was damaged in the process of "flash"
Ms. Wang, a citizen, runs a chain mobile phone shop on Jufeng Road in Pudong New Area. On July 14th, customers took a fancy to an iPhone XR mobile phone. Because there was no stock in the store, she transferred a new mobile phone from another store in Waigaoqiao through the "Flash Delivery" APP platform, which cost about 20 yuan freight. It rained heavily that day, and an hour later, Ms. Wang received her mobile phone, only to find that it was packed in a plastic bag with many water stains, so the mobile phone could not be turned on and had to be sent for maintenance. She suspected that the delivery staff did not take waterproof measures, which led to the water in the mobile phone. She complained to the flash platform, and the platform’s plan was to refund the freight and give some recharge coupons as compensation.
Coincidentally. Mr. Lin, the owner of the mobile phone retailer, recently deployed an iPhone X phone from the supplier through the flash platform. Before delivery, the supplier packed the mobile phone box, filled it with bubble film and put it into the express box, and specially told the delivery staff that there were valuables in the box, so that they could transport it carefully. However, after receiving the goods, Mr. Lin found that there were two cracks on the screen of the mobile phone, and he could only pay more than 1,000 yuan in advance for maintenance. When he negotiated with the flash platform, he got the answer that he could only pay 300 yuan.
More consumers are facing disputes and cannot get claims. Ms. Song runs a women’s clothing store, and often sends design drawings to suppliers, and then the suppliers process them and send them back to Ms. Song. She often uses flash delivery to deliver women’s clothing. On May 27th, Mr. Su, the person in charge of the supplier, delivered a batch of goods worth 1,000 yuan to Ms. Song through the flash platform and paid the freight in 80 yuan. It’s only a few kilometers from Huoxing Village, huaxin town, Qingpu District to Putuo District store where Ms. Song is located. On the way, the distributor suddenly informed the supplier that the goods were stolen behind the motorcycle and he had called the police. When Ms. Song contacted again the next day, the telephone number of the delivery staff could not be connected. Ms. Song complained about the claim to the flash platform, but the flash platform said that the invoice did not meet the requirements and there was no progress in the claim. "Flash delivery is a company registered in Beijing, and 12345 suggested that I contact the local authorities in Beijing to handle it." It took a lot of time and no feedback, so Ms. Song could only admit that she was unlucky.
The orientation of new format is vague and difficult to define.
Using the "Flash" APP, users only need to download the corresponding mobile phone software, complete the registration and mobile phone binding, and fill in the sender’s information and contact information, and then they can place an order for delivery. As long as the delivery staff uploads the certificate information through the flash platform, they can take orders after training. Xiao Chen works as a part-time distributor on the flash platform. He said that in order to become a distributor, he bought an electric car and spent 50 yuan to buy waistcoats and helmets for his part-time job. He and the platform agreed that after completing a single delivery, the platform would draw 20% from the freight and charge a personal accident insurance fee. The delivery clerk will deliver the goods to the recipient, and the delivery will not be completed until he gets the receipt code.
Judging from the mode of operation, "flash delivery" is really different from traditional express delivery. The Shanghai Postal Administration said that "the flash platform service is not within its supervision scope", based on the provisions of Article 84 of the People’s Republic of China (PRC) Postal Law, and express delivery refers to "the delivery activity that is quickly completed within the promised time limit". Delivery refers to the activities of "delivering letters, parcels, printed matter and other items to specific individuals or units according to the name and address on the package, including receiving, mailing, sorting, transportation, delivery and other links." Express delivery has the above four important links, with independent packaging and specific name and address attributes. Flash delivery does not have the above characteristics and does not belong to the category of express delivery service.
A staff member of the Shanghai Postal Administration said that many express delivery brands will provide delivery services on time and on time. These traditional express delivery companies have obtained express delivery business licenses before, and the information of couriers has been put on record. When consumers encounter disputes, both the company subject and the courier can find them. However, in the flash delivery platform, most of the delivery staff are part-time and the delivery process is short. As a dispatching platform, the company only plays the role of issuing instructions. "It is very similar to express delivery, but the mode is completely different."
